§2 General information on the collection, processing and storage of personal data
Personal data is only collected and processed by lexTM insofar as this is necessary to provide a functional website and the content and services we offer. This is regularly only the case if you give your consent (Art. 6 para. 1 lit. a GDPR), if this is necessary for the fulfilment of contractual or pre-contractual measures (Art. 6 para. 1 lit. b GDPR) or on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR).
1. “Personal data” within the meaning of the GDPR means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
2. encryption | In order to ensure an adequate level of protection within the meaning of Art. 32 GDPR, we take appropriate technical and organisational measures, in particular to ensure the confidentiality, integrity and availability of data. For security reasons, in particular to protect the transmission of personal data and other confidential content, we use TLS encryption for our website, which you can recognise by the character string “https://” and the lock symbol in your browser line.
§3 Collection, processing and storage of personal data when visiting this website
1. you can visit the lexTM website without having to provide personal data yourself (so-called informational use).
2. when you visit the website www.lex.tm, your browser automatically sends information to the server of our website. This information (so-called log files) is temporarily stored on the basis of our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR. In particular, this involves the following information Contents of the website, browser type and version, operating system used, referrer URL (the previously visited page), host name of the requesting computer, access date and time of the server request.
3. this data is only collected for the purpose of statistical analysis and for security reasons (e.g. to clarify acts of abuse or fraud), stored for a period of 7 days and then deleted. If it is necessary to store the data for longer for evidentiary purposes, it will not be deleted until the respective incident has been finally clarified.
§4 Collection, processing and storage of personal data using cookies
1. we use so-called cookies on our website. A cookie is a small text file that is used, among other things, to collect information about the use of a website. These cookies cannot execute programmes or transmit viruses to your computer.
2. lexTM itself or third parties commissioned by lexTM to do so store data on the storage medium of the end device you are using (e.g. a hard drive) in order to make the use of our website more user-friendly and effective overall. The legal basis is Art. 6 para. 1 lit. f GDPR.
3. unless cookies are technically absolutely necessary, we only set them with your previously declared consent, which you can also revoke at any time. The legal basis is Art. 6 para. 1 lit. a GDPR.
4. it is also possible to use our websites without cookies. You can deactivate the storage of cookies in your browser, restrict them to certain websites or set your browser to notify you as soon as a cookie is sent. You can also delete cookies from the storage medium of your end device, e.g. from the hard drive of your PC, at any time. However, we would like to point out that you may then not be able to use all the functions of our website properly.
§5 Contacting us
If you contact us by e-mail, your IP address and the time your e-mail was sent will be recorded. The personal data you send us with your e-mail will be stored. The data you provide will only be used to process your enquiry. The data will not be passed on to third parties unless this is explicitly stated in this data protection notice.
§6 Duration of storage of personal data
Unless expressly stated in this data protection notice, the data stored by us will be deleted as soon as it is no longer required for its intended purpose and the deletion does not conflict with any statutory retention obligations. If the data is not deleted because it is required for other and legally permissible purposes, its processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons.
§7 Your rights
You can contact us at any time with regard to your rights and further questions on the subject of personal data using the contact details provided in section 1 above. You have the following rights:
1. right to information | You have the right to request information free of charge at any time about your personal data stored by lexTM, its origin and recipients, the purpose of data processing, the planned duration of data storage, including a copy of the personal data that is the subject of processing (Art. 15 GDPR).
2. right to rectification | You also have the right to have inaccurate personal data rectified or incomplete personal data completed at any time (Art. 16 GDPR).
3. right to withdraw consent | You have the right to withdraw your consent to data processing at any time and with effect for the future, without the need for a reason for withdrawal (Art. 7 para. 3 GDPR).
4. right to erasure | You have the right to have your personal data erased immediately if they are no longer necessary for the purposes for which they were collected or otherwise processed or if you withdraw your consent to lawful processing and there are no other legal grounds for storage. If you object to the processing and there are no overriding interests for the processing, your data will also be deleted. Finally, the data will be deleted if the processing is unauthorised for other legal reasons (Art. 17 GDPR).
5. right to restriction of processing | You have the right to have the processing of your personal data restricted if you dispute the accuracy of your personal data for a period of time that enables us to verify the accuracy of your personal data. Processing may also be restricted if the processing is unlawful but you oppose the erasure of your personal data and request the restriction of their use instead of erasure, if we no longer need your personal data for the purposes, but you require them for the establishment, exercise or defence of legal claims, or if you have objected to processing pending the verification whether lexTM has legitimate grounds to store the data that override your interests (Art. 18 GDPR).
6. right to data portability | You have the right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to transmit it to another controller, provided that the processing is based on consent and the processing is carried out by automated means (Art. 20 GDPR).
7. right to object | You have the right to object at any time to the creation of user profiles and to the processing of your personal data concerned, provided that the processing is based on Art. 6 para. 1 lit. e or f GDPR. Your personal data will no longer be processed unless there are compelling legitimate grounds that outweigh your interests, rights and freedoms. If your personal data is used for the purpose of direct marketing, you naturally have the right to object to such processing at any time (Art. 21 GDPR).

§8 Validity and timeliness
